Our firm provides representation to owners of affordable housing and real estate with particular emphasis on federally subsidized and financed multifamily and senior citizen properties. We focus primarily on the representation of nonprofit sponsors and owners of multifamily government financed and assisted multifamily housing projects and senior citizen projects. We are closely involved with affordable housing transactions and related management and administrative enforcement issues on a daily basis, and provided representation in connection with a wide variety of affordable housing issues, including:
- The construction, rehabilitation, acquisition, sale and refinancing of affordable housing developments, using mortgage insurance, direct loan and grant programs of the United States Housing and Urban Development Department (HUD)
- HUD Section 202 prepayment and repositioning initiatives
- Section 8 contract expiration, renewal, and opt-out
- HUD regulatory compliance
- New York HPD 8A and HOME programs
- New York State Nonprofit and Private Housing Finance Law issues
- New York Article 11 tax exemption filings
On an ongoing basis, we advise on day-to-day operations and compliance with HUD and federal regulations, and, when required, handle administrative enforcement and litigation matters that may arise in connection with the ownership and management of regulated and subsidized properties.
